An open letter to California Employers and HR Professionals

Dear Friend,

I’m sure it’s no surprise to you, but it is bewildering.

When the U.S. Department of Labor passed additional rules governing the federal Family and Medical Leave Act (FMLA), your job didn’t get any easier.

The intent of the law is to help enable employees to balance their work and family life by taking reasonable unpaid leave.

But confusion reigns about the so-called family medical leave act. California has its own family rights act, and while the laws are similar, there are numerous key differences.

The California Family Rights Act (CFRA) grants eligible employees a total of 12 workweeks of unpaid leave during any 12-month period to:

  • Care for a newborn, newly adopted child, or newly placed foster child.
  • Care for an immediate family member (spouse, child, parent, or registered domestic partner) with a serious health condition.
  • Take medical leave for the employee’s own serious health condition.

Simply put, California family leave is more generous than FMLA leave.

For example, CFRA covers a domestic partner and his or her child, but the FMLA does not, so it supersedes the FMLA in California. But interpreting FMLA in California still requires reconciling it with CFRA.
